If you lose receipt for washing machine, does that exclude makers from further commitment ?

bought whirlpool wash. machine from argus 9mths ago , now broke down susp. motor ? daughter cant find receipt, argos not interested and whirlpool saying they need it too, are these parties correct in what stateing. If you lose receipt for washing machine, does that exclude makers from further commitment ?
how did you pay?

if card then on your statement.

if cash, go back to another argos store and say was a gift with no reciept.

however, i suspect your brushes need replacing. these cost 12 quid and are easy to fit. get a bloke to look at the length of the carbon. should be about 30 mm, any less change them first then go back to argos.

brushes wont be included on warranty and you'll just get a big bill
If you don't have a card receipt a bank statement is a legal substitute which Argos have to accept. If you lose receipt for washing machine, does that exclude makers from further commitment ?
They are not correct in insisting on receipts. However, they are correct in requesting proof that you bought it from Argos within a reasonable time.

Legally it is the retailer that is liable for support of the machine for the duration of the guarantee. This is a provision of the Sale of Goods Act (follow the BERR link below).

The manufacturer may support or suppliment this responsibility but the retailer cannot shrug it off.

The Act also states that goods must be Fit for Purpose and Of Merchantable Quality. In practice this means that there is a responsibility even when the guarantee has expired, providing that the goods have been used in the approved manner.

In Law you do not have to produce the receipt. However, some proof of purchase from that retailer may reasonably be required. This could be a cheque or credit card statement.

If the retailer and maker are being awkward you could also quote the FULL model and serial number details at them. If you still have the box with the Argos catalogue label on it then will help.

This will enable the history of the machine to be traced from completion at the factory to shipping via Argos and the timescales involved. Even if it's sitting with Argos for a month before sale you should be accurate enough. I would doubt that Argos will keep stock for longer than that.

You must expect the person on the phone to deny that this is possible, so you should insist on "escallation" to someone with proper authority.

Make notes of the date and time of the conversation (so that can be comapred with your phone bill if they later deny that it happened). Ask for their full name (not just "hello I'm James..."). Quote the Act and threaten legal action against Argos in the Small Claims court.

If you write or email then keep paper copies of all correspondnce.

Be prepared to take the matter to your local Trading Standards Office (number in phone book). They will support you and provide expert advice.

Good luck and enjoy the chase.
Most major appliances have a registration card you are required to send to the manufacturer to cover warranty claims. Did you send it in?If you lose receipt for washing machine, does that exclude makers from further commitment ?
without a receipt they would go by the serial # which would contain the date of manufacture. this may not help as it may have sat in a warehouse for a while.
